We hope each of you had a wonderful and enjoyable Summer and that the Fall now finds you well. We have had a wonderful year so far at Wyngate Commons as our HOA continues to refine and develop. Over the last 3-4 months, about 20 volunteer leaders from throughout our community have taken on some large, time consuming tasks, and we as a board are amazed at how much has been done is such a short period of time. Please take a moment to become familiar with what has been accomplished and what we hope to achieve as a community:

Website
In an effort to increase the communication within the community and supply each of you with pertinent and timely information, we have created the website www.wyngatecommons.com . We encourage you each to become familiar with it and join the email list. We’ll be periodically emailing community news and HOA minutes through this site. On this site you can use the Submission Form to reserve the pavilion, request assistance, or communicate with the Board. You can also find information on our emergency preparedness plan, new move-in information, links, HOA minutes, a calendar, and much more. If you have any repairs that need to be done around the community, take a moment to fill out a submission form on the site (even if you have previously sent one in on paper) before Tuesday, October 7^th. We will be prioritizing fixes and hiring a repair man, so if you don’t put in the submission, you won’t be a part of the fixings.

Rules and Regulations
One of the 2008-09 goals was to comb through, refine, and finalize the governing rules and regulations at Wyngate (including penalties for breaking the rules). We noticed this was essential to keep our neighborhood safe and enjoyable for all. This has taken several months to complete and has involved large amounts of input from the community. The finalized list can be found at www.WyngateCommons.com and is also attached to this newsletter. Please become familiar with these rules ASAP. We have a few new ones and will be enforcing all these rules within the next month. For example, cars are no longer allowed to park on top of sidewalks or in driveways at any time and cleaning fees for oil drippings will be charged to the car owners.

Paid Parking
As one of the biggest issues in the last 6 months, we have come up with solutions to satisfy the majority of parking concerns. We will now be renting out paid parking spots to residents who require additional parking spots. [See the attached Paid Parking Application form for more details.] Starting November 1, community members using Guest parking will be towed.

Gated Community and Community Watch
We are actively working to increase the safety, security, and property values of our community as part of our 2008-09 goals. Over the up-coming months we will be developing a neighborhood watch program and will continue to meet with Draper City in order to get permission to make Wyngate a gated-community. As part of this effort, we need to build a case supporting this goal, and so we encourage you each to use the Submission Form on our website to immediately notify us of any vandalism, intruders, or any other disturbance to our community. We will let you know how our efforts proceed as the months roll on.

Wyngate BBQ 2008
As part of our goal to strengthen community bonds at Wyngate, in August we had our first neighborhood-wide BBQ. We had a total of nearly 50 people in attendance and it was a HUGE success, mainly because of the hard work Mercedes and her family did. We’d like to thank Mercedes again and all those who contributed. We plan to have at least one large activity each year and in between, we encourage you to continue reaching out to and getting to know your neighbors.

2009 – Quarterly Leadership Meetings (anticipated)

As 2008 approaches, we want to thank each of you for a wonderful 2007! Taking over an HOA isn’t always easy, but because of your cooperation and contributions, things have been extremely smooth and virtually problem free. We, as a board, are excited to continue donating our time and attention to serving you and are grateful that you too have been so willing to help.

Also, thank you for being so cooperative on complying to Draper’s parking policies so well. The towing company has been amazed that they haven’t found business in our neighborhood yet. Let’s continue to keep the streets and driveways clear between 12am and 6am, and to respect that visitor parking is typically for visitors, not tenants.

So, on to some business:

HOA Dues: Enclosed you will find our new HOA coupon books, and you will find an increase in dues. After reviewing our budgets and crunching numbers, we noticed some landscaping and insurance expenses weren’t fully accounted for previously. In order to continue running our community smoothly, the board found it necessary to raise our dues to $130 to avoid future complications. We believe you understand our concern to wisely manage our funds and keep our accounts problem free.

Holiday Decorations: We encourage holiday displays (that are tasteful, of course) and remind you that the use of nails and screws to hang holiday decorations is not allowed on the exteriors of the community (no permanent fixtures).

A Few Community Expectations: Remember to keep all common space and limited common space (like your back yards) clean and orderly. For example:

· Keep alleyways between the homes free of personal belongings.

· Garbage should be tightly bagged before placed in garbage cans (we’ve had problems with the wind blowing trash out of the cans). Also, garbage cans should be stored in your garages and not in the alleyways or back yards.

· Any plans to make meaningful changes to your back yard must be submitted to your Street Rep and approved by the board. This includes the installation of hot tubs, pergolas and other porch coverings, etc.

Neighborhood Watch: Let’s continue to watch out for our community during the increase in visitors to our community during the holiday season. If you observe anything suspicious, let your Street Representative and/or the local police know, immediately. An added measure of awareness can make a big difference towards having a safe and enjoyable holiday season.

Dear Homeowners,

Happy New Year! We hope everyone had a safe and enjoyable holiday season. We wanted to provide a quick update of some important community issues and notify you of some important changes:

Snow Removal

In case you didn’t notice, we had unexpectedly high amount of snowfall during the month of December. The cost of snow removal during December was greater than half of the amount that has been budgeted for the entire season. As a result, the Board has been considering various methods of keeping snow plowing costs under control.

As has always been the case, the company that plows our community will generally not come until there is at least 2 inches of snow on the ground AND it appears that the snow has stopped falling. Until that happens, homeowners are requested to keep their walkways clear of snow and ice.

As of today, your street representatives have been given bags of Ice-Melt which can be applied to the sidewalks and other icy areas. If you would like to keep some of this Ice-Melt in your garage, please ask your street representative.

Also, the Board is aware that there are sections of the community where the drainage of melted snow is inadequate, creating an icy and potentially dangerous situation. We are actively seeking to resolve this matter. In the meantime, please be cautious when walking in these areas.

Exterior Lights

Your street representatives have also been given replacement bulbs for the exterior of your homes. They will be replacing these bulbs as needed. If you notice a dead bulb, please don’t hesitate to bring it to their attention.

Garbage Cans and Common Space

In order to promote a clean and orderly community, it has become necessary to implement a policy relating to the storage of garbage cans and the use of common space:

• Garbage cans cannot be placed on the street prior to Wednesday and should be picked up no later than Friday.
• Garbage should be tightly bagged before being placed in garbage cans (we’ve had problems with the wind blowing trash out of the cans).
• Garbage cans must be stored in your garages and not in the alleyways or back yards. Alleyways between the homes must be kept free of ALL personal belongings.

Homeowners that do not comply with this policy will be subject to a fine. The fine will be $50 for the first offense and $100 for each additional offense.

We are extremely grateful for the efforts of all the community members to make this a better place to live.

Dear Community Members,

We would like to thank everyone who braved the wind and rain to attend the Homeowner Association meeting last Tuesday. As a Board, we are happy to see the interest and level of involvement in making Wyngate Commons a great community. Since there were many who were not able to attend, this letter will outline the major announcements that were made at the meeting:

Street Representatives

• We introduced the Street Representatives, who will be the primary contact person for all of your community related concerns. The included map will help you determine who your Street Rep is and how to contact them. They will be your resource in case of: landscaping issues, exterior lighting, community disturbances, etc. If they are unable to resolve your concern, they will elevate it to the HOA Board members. Please see included map and Street Rep Guide. These will also be indicated on the Wyngate Community Directory (coming soon).
• Please use the Submission Form (copies are included in this packet) to notify your Street Rep of any concerns. This is critical to use in resolving any issues, concerns, suggestions, etc. especially for a brand new community. There will be no issues considered for resolution unless properly documented via these forms. Please be as complete in your remarks as possible. These are to be submitted to your Street Rep directly.
• Submission Forms are also to be used for requests, suggestions, comments, etc.
• To better help and promote our new community, we will be providing Community Maps and a Community Directory with Street Rep, Board and all Homeowners info that live within our community.
• This community info is for Homeowners of the Wyngate Commons ONLY. In order to preserve the privacy of our community members, the Community Directory is not to be distributed outside of the Community for ANY reason.
• We have most of your information, but we have some gaps. Please get a hold of your Street Reps and provide that information so that we know who everyone is.
• If you would like to receive the HOA Monthly Newsletter (coming in the next few months) via email, please also include your email address.
• On the Community maps, we have labeled each Cluster or Block of homes by the letters “A” through “M”. Please note which Block you belong to and get to know you Street Reps well so we can handle any issues or concerns as quickly as possible.
• We will be instituting a Neighborhood Watch program in 2008 and would like everyone to participate and give feedback on how to carry this out. Please submit any suggestions or interest in being involved.

Landscaping Update

• The replacement of damaged fencing, concrete, grass, and trees is continuing. If you are aware of any issues that you think have escaped the attention of the Board members, please notify them by using a Submission Form, to be submitted to the Street Rep.
• Winterization of the sprinkler system is underway and will be completed soon.
• Your backyard has been designated as Limited Common space. This means that while you are entitled to use of the space, it remains the property of the community. As such,

- Your back yard must remain unlocked to allow access to the sprinkler control valves in case of emergencies. A broken pipe in your neighbor’s yard may be controlled from the box in your yard. If you have restricted access to the control box, you may become liable for the damage that is caused.

- Gates must remain unlocked so that landscaping maintenance can be performed. Exceptions to this rule must be approved by the Board.

• Pet waste must be cleaned from all areas of the community, including back yards. Failure to do so will result in a fine.
• Garbage cans should be returned to your garage promptly once they have been emptied. Also, please tightly bag all garbage that goes into your can. Doing so will minimize the amount of trash that gets spilled in the community.

Parking Policy / Enforcement

• This is a two-car community and all cars should be parked in a garage. If you have vehicles that do not fit in your garage, a storage solution outside of the community should be arranged.
• The CC&Rs and Draper City require that no street parking is allowed as it can impede emergency response crews and snow plowing efforts.
• Enforcement of the existing parking restrictions will begin in earnest, effective November 15th.
• Vehicles parked on the street or in the driveways will be towed or booted.
• Visitor parking is available in specific locations throughout the community and should not be regularly used by homeowners. Any car that remains in visitor parking, without being moved, for more than 48 hours will be booted or towed.
• Towing will initially occur between midnight and 6am until the effectiveness of the policy can be assessed.

Financial Overview and HOA Dues

• HOA accounts are adequate and appropriate for the community’s needs.
• HOA Dues are payable on the 1st of each month; as of the 10th of each month, a late fee is incurred.
• A delinquent notice is mailed on the 10th of each month for all delinquent accounts.
• We do not currently anticipate any changes to the accountant for our community. There will be no change in the address to which payments are sent. New coupon books will be mailed to all homeowners closer to the end of the year.

We appreciate the efforts that each of you have made to make this community a better place to live. We feel that it is a great community and we hope you feel the same way too. If you have any concerns or problems that we can address, please bring them to the attention of your Street Rep and we will all work to find a solution.
